CreditPop Terms of Service
The following are terms of a legal agreement (the "Agreement") between you ("Tenant" or "Resident" or "you") and RentTrack, Inc. ("RentTrack", "CreditPop", "we", or "us"), that sets forth the terms and conditions for your use of this Site (the "Site"). CreditPop is a division of RentTrack, and The CreditPop Site is owned and operated by RentTrack, Inc. Trusted Partners ("Trusted Partners" or "Partners") are those services we rely on to deliver the CreditPop service, whose terms have either been incorporated here, or linked at the bottom. This Site is being provided to you expressly subject to this Agreement. By accessing, browsing, and/or using this Site via any medium, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement and to comply with all applicable laws and regulations.
Changes to Agreement
We reserve the right to amend this Agreement, at our sole discretion, at any time and may notify you by sending you an email or by posting the updated terms on our Site. You should check this Agreement periodically for changes. All changes shall be effective upon posting and shall supersede all previous versions. Your continued use of the Site after any change to this Agreement constitutes your agreement to be bound by any such changes. We may terminate, suspend, change, or restrict access to all or any part of this Site without notice or liability.

Initial CreditPop Terms of Service
CreditPop and its Trusted Partners provide tenant, lease and rent verification services, rent reporting services, credit retrieval and monitoring services, and qualified offers from our Partners that are partially based on these services.
CreditPop provides Tenants with the ability to report rent payments to the major credit bureaus (the "Reporting Services"). Tenant acknowledges that each bureau has unique approaches to rental payment data furnishing and reporting. Rental payments and Utility payments, if elected, will be reported to major credit bureaus for any tenant who connects their bank account to RentTrack, who identifies Rental or Utility payments, and who verifies their identity within RentTrack. If desired, Tenants have the ability to "opt-out" of the Reporting Services by cancelling their subscription or contacting support. While CreditPop takes all commercially reasonable steps to report data correctly to the credit bureaus according to their methods and recommendations, CreditPop cannot guarantee the accuracy of the data on Tenant's credit report. Tenant understands that it may take up to three months for rental payment data to appear on credit bureau records. If Tenant deems any payment data found on their credit report incorrect, CreditPop will assist Tenant in investigating the issue upon receipt of a request from Tenant. In addition, Tenant may file a dispute with CreditPop (RentTrack, Inc.) or directly with the credit bureaus. Tenant understands that a credit freeze does not prevent CreditPop from sending data to the credit bureaus. A credit-freeze only prevents the credit bureaus from providing CreditPop and others with information from Tenant's credit profile. The data displayed by CreditPop regarding rental history is only a representation of the Tenant's tradeline, and not actual data from the credit bureaus. Tenant should review their credit profile at each bureau in order to verify the accuracy of the rent reporting.
In addition to the services above, we may collect Tenant information, including but not limited to information retrieved from integrated accounting systems from RentTrack's Property Managers, our application, the connected bank account, and the credit bureau such as credit score, credit profile data, or consumer entered or verified information such date of birth. Based on this information, we may present Tenant with offers from Trusted Partners (the "Prequalified Affiliate Offers"). These offers may be presented through a variety of communication channels, including but not limited to email (if Tenant has not unsubscrived), Site ad placements, telephone and others. These offers may be presented to you by CreditPop, RentTrack, or directly by our affiliates.
With respect to Prequalified Affiliate Offers, we do not guarantee that you will be presented with offers for any particular types of products or services or that you will meet the approval criteria for any particular offer. Furthermore, we should not be misconstrued as offering these products to you directly.
CreditPop will receive Tenant's credit score from one or more credit bureaus. All of our Scores may not be used to grant credit.
The Services and Affiliate Offers are not intended to provide any credit repair, legal, tax or financial advice. We cannot guarantee any improvement in credit scores. CreditPop may offer a refund on our subscription services, should CreditPop fail to deliver the service we agreed to deliver on. CreditPop's satisfaction guarantee cannot be claimed as a result of your credit score not improving. Tenant acknowledges that CreditPop is not a Credit Bureau and does not have direct influence over any aspect of credit, credit profiles, or how credit scores are calculated.
User Content You Share Becomes Public
In addition, we may be required to disclose your User Content to third parties if we have a good faith belief that access, use, preservation or disclosure of such User Content is reasonably necessary to (a) satisfy any applicable law, rule, regulation, legal process or enforceable governmental request, (b) enforce these Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of RentTrack, its users or the public as required or permitted by law.
Obligation to Provide Accurate and Complete Information Where Required
In order to provide the Reporting Services and Prequalified Affiliate Offers, CreditPop is obliged to employ reasonable authentication methods to verify the identity of Tenants and accuracy of the Lease and related Payments. In order to use the Services, you agree to: (i) provide information about yourself and any associated business that is true, accurate, and complete as prompted by the Service's sign up process, (ii) where applicable and appropriate, maintain and update your information to keep it true, accurate, and complete, and (iii) allow us to contact your Landlord or Property Manager, as necessary, to confirm details of your payments and lease. In the event that you falsify information, or provide inaccurate, untrue, or incomplete information, CreditPop may, at its sole discretion, suspend or terminate your access to the Reporting Services and deny any future access to the Reporting Services. You may not use the Reporting Services for any illegal purpose or in any manner inconsistent with the terms and conditions of this agreement.
For subscription payments (those payments made for the Services such as credit monitoring), CreditPop will issue a full refund if the customer is not satisfied with the service. As stated above, CreditPop's satisfaction guarantee cannot be claimed as a result of your credit score not improving. If the subscription was for rent payment reporting via a bank connection, we will first attempt to finish the tradeline if a sufficient number of rent payments have been reported. However, any entry created on the consumer's credit report may be deleted if insufficient payments were reported, and the consumer will not receive any credit for their rent payments.
Some of the Reporting Services mentioned in this agreement may only be available for a fee. You will only be charged for fee-based services after we obtain your consent to pay such fees. We reserve the right to change fees for access to the Reporting Services, or to change what features are available at different fee levels, at any time. You shall pay all fees incurred through your use of the Reporting Services at the rates in effect for the billing period in which such Services are delivered.
As a Tenant, you may have the opportunity to purchase additional Credit Services beyond any free or paid Services we provide. These additional services are not related to the Prequalified Affiliate Offers, and may display different credit information than we use for the Prequalified Affiliate Offers.
Either you or CreditPop may cancel use of the Reporting Services with or without cause at any time. You may cancel the Service by emailing email@example.com, or by cancelling the Subscription within the application.
Specific Consents Granted by your Enrollment
At the time that you verify your identity, you agree that you are providing to us the following specific consents (in addition to being subject to this Agreement):
You understand that by enrolling in RentTrack services, you are providing 'written instructions' to RentTrack, Inc under the Fair Credit Reporting Act authorizing RentTrack, Inc to obtain information from your personal credit profile or other information from Experian, TransUnion, or Equifax. You authorize RentTrack, Inc to obtain such information to verify your identity, provide you with your score and aggregated credit information, and to enable rent reporting to major credit bureaus. You may opt-out of rent reporting at any time by logging into your account and changing your settings or cancelling your subscription.
Note that CreditPop does not extend credit to residents. CreditPop merely reports on the status of rent payments. If we are unable to verify the identity of all parties involved in a transaction, CreditPop reserves the right to deny use of our Reporting Service and any additional service or product offered by CreditPop, in accordance to KYC (Know Your Customer) and AML (Anti Money Laundering) payment processing regulations, or for any fair reason that we may deem will materially affect the business. However, at no time should this denial be misconstrued as a denial of credit.
CREDITPOP, RENTTRACK, ANY OF ITS AFFILIATES, PROVIDERS OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, INDEPENDENT CONTRACTORS OR LICENSORS (COLLECTIVELY THE "RENTTRACK PARTIES") DO NOT GUARANTEE THE ACCURACY, ADEQUACY, TIMELINESS, RELIABILITY, COMPLETENESS, OR USEFULNESS OF ANY OF THE CONTENT AND RENTTRACK DISCLAIMS LIABILITY FOR ERRORS OR OMISSIONS IN THE CONTENT. WITH RESPECT TO THE SERVICES YOU HEREBY ACKNOWLEDGE YOUR UNDERSTANDING THAT RENTTRACK IS SOLELY AN INTERMEDIARY BETWEEN YOU AND THE CREDIT REPORTING AGENCIES (EXPERIAN, EQUIFAX, TRANSUNION) ACTUALLY FURNISHING THE CREDIT PROFILES AND SCORES AT ISSUE AND BETWEEN YOU AND THIRD-PARTY SITES (IN THE CASE OF THIRD PARTY PRODUCTS AND SERVICES); THEREFORE, THE RENTTRACK PARTIES HEREBY EXPRESSLY DISCLAIM ANY LIABILITY FOR THE INACCURACY OR INCOMPLETENESS OF ANY SUCH CREDIT PROFILES AND SCORES OR FOR THE CONTENT, AVAILABILITY, OR LEGALITY OF ANY OF THE PRODUCTS AND SERVICES MADE BY THE THIRD-PARTY SITES.
THIS SITE AND ALL OF THE CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTY, EITHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR TITLE. ADDITIONALLY, THERE ARE NO WARRANTIES AS TO THE RESULTS OF YOUR USE OF THE SITE, CONTENT OR SERVICES. THE RENTTRACK PARTIES DO NOT WARRANT THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, NOR THAT ANY INFORMATION THAT YOU PROVIDE TO THE WEBSITE WILL BE SECURE. THIS DOES NOT AFFECT THOSE WARRANTIES WHICH ARE INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.
CREDITPOP MAY DISCONTINUE OR MAKE CHANGES IN THE SITE, THE CONTENT, AND/OR THE SERVICES AT ANY TIME WITHOUT PRIOR NOTICE TO YOU AND WITHOUT ANY LIABILITY TO YOU OR ANY THIRD PARTY. ANY DATED INFORMATION IS PUBLISHED AS OF ITS DATE ONLY, AND THE RENTTRACK PARTIES DO NOT UNDERTAKE ANY OBLIGATION OR RESPONSIBILITY TO UPDATE OR AMEND ANY SUCH INFORMATION. CREDITPOP RESERVES THE RIGHT TO TERMINATE ANY OR ALL SITE OFFERINGS OR TRANSMISSIONS WITHOUT PRIOR NOTICE TO YOU. THIS SITE COULD CONTAIN TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS. USE OF THIS SITE IS AT YOUR OWN RISK.
Limitation of Liability
UNDER NO CIRCUMSTANCES WILL THE RENTTRACK PARTIES BE LIABLE FOR ANY DAMAGES INCLUDING, WITHOUT LIMITATION, GENERAL, SPECIAL, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR ANY OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR BUSINESS INTERRUPTION) OF ANY KIND WHETHER IN AN ACTION IN CONTRACT OR NEGLIGENCE ARISING OR RELATING IN ANY WAY TO THE USE OR INABILITY TO USE BY ANY PARTY OF THE SITE, THE CONTENT, THE SERVICES, OR ANY THIRD-PARTY SITE TO WHICH THIS SITE IS LINKED, OR IN CONNECTION WITH ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR LINE OR SYSTEM FAILURE, EVEN IF THE RENTTRACK PARTIES, OR REPRESENTATIVES THEREOF, ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, LOSSES OR EXPENSES. THE RENTTRACK PARTIES ARE NOT LIABLE FOR ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY USER. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THIS SITE, THE CONTENT, AND/OR THE PRODUCTS IS TO STOP USING THE SITE AND TO NOTIFY US THAT YOU NO LONGER DESIRE TO RECEIVE THE PRODUCTS. IF YOUR USE OF THIS SITE, THE CONTENT, AND/OR THE PRODUCTS RESULTS IN THE NEED FOR SERVICING, REPAIR OR CORRECTION OF EQUIPMENT OR DATA, YOU ASSUME ANY COSTS THEREOF. IF ANY OF THE FOREGOING LIMITATIONS ARE FOUND TO BE INVALID, YOU AGREE THAT THE RENTTRACK PARTIESÕ TOTAL LIABILITY FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION OF ANY KIND OR NATURE WHATSOEVER SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.
Monitoring of the Site
CreditPop has no obligation to monitor the Site; however, you acknowledge and agree that CreditPop has the right to monitor the Site electronically from time to time and to disclose any information as necessary or appropriate to satisfy any law, regulation or other governmental request, to operate the Site, or to protect itself or other users of the Site.
Submissions Through The Website
Links to or Connections with Third Party Sites or Applications
Our Services or communications to you may contain third party content or links to third party sites, applications or services (collectively, "Third Party Content"). Our Services may also include features that allow you to connect your RentTrack account with accounts or services provided by third parties, such as accounts you maintain with financial institutions or social media platforms like Facebook (collectively, "Third Party Services"). We do not control, maintain, or endorse the Third Party Content or Third Party Services, and we are not responsible or liable for any Third Party Content or Third Party Services, including any damages, losses, failures, or problems caused by, related to, or arising from Third Party Content or Third Party Services. Your interactions and business dealings with the providers of the Third Party Content or Third Party Services, including products or services offered by such third parties, are solely between you and the third party. You should review all of the relevant terms and conditions associated with Third Party Content or Third Party Services, including any privacy policies and terms of service. We are not responsible for any information that you agree to share with third parties in connection with Third Party Content or Third Party Services.
Security Features and Website Requirements
RentTrack uses best-practice security measures as defined by PCI Data Security Standards, as well as third-party verification and encryptions services, to protect your privacy and safeguard your information. Because we use these security measures, we may not always be able to successfully provide our Services to you, so we do not guarantee or warrant that we will be able to provide any such Services to you, even if you enroll for such Services.
RentTrack may use your personal information to the extent necessary to provide Services. To enroll and use the Site and Services you must have an email address, a modern Java-script compatible browser, and enable cookies.
Governing Law and Dispute Resolution
This Agreement shall be subject to and construed under the laws of the State of California, without reference to the conflicts of law provisions thereof. Exclusive venue shall be in Santa Barbara County, California.
You understand and agree that all claims, disagreements, disputes or controversies between you and RentTrack, and its officers, directors, employees, representatives, agents, parents, affiliates, subsidiaries (including CreditPop, and related companies, whether they arise from your use of this Website or from any other aspect of your relationship with RentTrack, shall be resolved by final and binding arbitration before JAMS (Judicial Arbitration and Mediation Service) in Santa Barbara or the nearest available location, in accordance with JAMS' commercial arbitration rules in effect at the time the proceedings begin. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The costs of arbitration shall be equally paid by the parties. The parties voluntarily and knowingly waive any right they have to a jury trial.
Exclusivity and Billing
Tenant agrees that CreditPop is sole, exclusive provider of Reporting Services and Tenant agrees to pay The CreditPop Fees as outlined during enrollment for Services. CreditPop charges Tenant monthly and payment is due upon receipt. If the credit or debit card is declined, Tenant will be notified to change the payment source. Any fees not paid for one month will result in a delinquent subscription, and CreditPop will stop Reporting Services until fee is collected. After three months of a delinquent account, CreditPop can remove any tradeline from the Tenant's Credit Report.
If any provision of this Agreement is deemed to be unlawful or unenforceable, it will not affect the validity and enforceability of the remaining provisions.
This Agreement is effective until terminated by either you or CreditPop as set out below.
If you want to terminate your legal Agreement with CreditPop, you may do so by (a) notifying CreditPop at any time by sending an email to customer support with the subject "Termination of Service" or (b) by stopping and periodic or recurring payments. Upon any termination of this Agreement, you shall promptly discontinue use of the Site and the Services and your right to access and use the Site and Services will terminate immediately.
CreditPop may terminate this Agreement at any time without notice, or suspend or terminate your access and use of the Site, the Content, and/or the Services at any time, with or without cause, in CreditPop's absolute discretion and without notice.
The following provisions of this Agreement shall survive termination of your use or access to the Site: Disclaimer of Warranties, Limitation of Liability, Submissions Through the Website, Specific Consents, Granted by Your Enrollment, Trademarks, Governing Law and Dispute Resolution, Waiver, Indemnification, General Provisions, and any other provision that by its terms survives termination of your use or access to the Site, the Content, and/or the Services.
CreditPop will maintain the most basic personal information (email address) to enable future activation or use of Site, the Content, and/or the Services in the event you terminated the Agreement.
Failure by CreditPop to enforce any of its rights under this Agreement shall not be construed as a waiver of those rights or any other rights in any way whatsoever.
Headings used in this Agreement are provided for convenience only and shall not be used to construe meaning or intent.
This Agreement constitutes the entire agreement between CreditPop and you in connection with your use of the Site, Content and the Services, and supersedes any prior versions of the Terms of Service, if applicable. This Agreement will be binding on, inure to the benefit of, and be enforceable against the parties and their respective successors and assigns. Neither the course of conduct between parties nor trade practice shall act to modify any provision of this Agreement. All rights not expressly granted herein are hereby reserved.
Third Party Terms
As a Tenant utilizing our Reporting Service, and when connecting to your bank account, you agree to the Plaid Terms of Service.

Types and Use of Information We Collect
Information You Provide to Us
You may provide information to us in various ways, such as through forms, features or other means offered through our Services. A couple of examples include information you provide to us when registering as a member, and feedback forms where you send us comments, questions, or other feedback. The types of information you provide us fits into two general categories:
Personal Information: CreditPop collects the following Personal Information from you when you sign up and use our Services: Contact Information - name, email address, mailing address, phone number, etc.; Identity Verification Information - Social Security Number, date of birth, cellular phone number, person associated with the identified bank account, etc; Payment Information - credit card or bank account numbers, billing addresses, bank account transactions, etc.
Non-Personal Information: This is information about you or your household that doesn't identify you personally, including but not limited to: gender, salary, demographic data, marital status, loan and credit card monthly payment, total amount and interest rates, home value, etc.
Information We Automatically Collect
In addition to information you provide to us, we automatically collect certain information about how you access and interact with our Services ("Usage Information"). This Usage Information is a key part of how we improve your CreditPop experience and provide you with more personalized insights and recommendations. We and our partners may use various technologies to collect and store Usage Information in connection with our Services. These may include things like cookies, browser web storage (e.g., HTML5), web beacons and similar technologies. There are three types of Usage Information we may collect:
Device Information. This is information about how you access our Services, such as the operating system, hardware model, application or browser type and version, and unique identifiers associated with your device. We may also integrate with built-in device features.
Log Information. There are certain pieces of information we automatically collect in system logs or similar files about how you interact with our Services, such as which features you visit or click on. This Log Information may also include things like your IP address, browser or device configuration, date and time of access and cookie information.
Location Information. We may use certain information like your IP address or other Device Information or Log Information to estimate your location (e.g., your city or state). We may also request to use location-enabled services on your device (which typically provide GPS or Wi-Fi access point details) to enhance our Services. We will only use these location-enabled services on your device with your consent.
Information Third Parties Provide About You
Some of our features rely on information about you that we collect from third parties, such as the credit reports and credit scores we request on your behalf from Experian, TransUnion and Equifax. We may also work with different third party partners to supplement the Usage Information and other information we collect directly from you. For example, our partners may provide us with information such as employment or income data, vehicle or driver information, or information about special offers available based on your credit profile so that we can give you more personalized recommendations. We might also collect information from other users like you through things like a member referral program.
Use of Your Data
We use the information we collect from you and third parties to operate our Services, communicate with you, conduct research and development to improve or enhance our Services and our users' experience, and promote our Services. These are a few examples:
To create your account and provide the Services to you. We use the information we collect to create and secure your account, create and maintain your account, and to provide the Services to you.
To provide features to you, such as your credit score and profile. We use the information we collect to provide you with credit profile analysis and simulation for, credit score display and monitoring, rent payment reporting to credit bureaus for and full credit report purchase. The information we collect also goes into developing and bringing you various other features and personalized offer recommendations.
To improve our recommendations and insights. The information we collect also helps us tailor our content and improve the way we match you to recommended offers or insights.
To communicate with you, either directly or through our partners. We use information we collect to provide you with member support or to send you things like service-related announcements, recommendations, offers from our partners and other updates or promotions. Most of the time we'll communicate with you by email, but we may also send you push notifications, browser notifications, or physical mail.
To conduct research and to improve and promote our services. We use the information we collect to conduct research and to improve or enhance and promote our Services.
For legal reasons. We reserve the right to access, use, preserve, transfer or disclose, at any time without notice to you, any information (including Personal Information) as reasonably necessary to:
Comply with any applicable law, regulation, subpoena or legal process, or respond to any governmental requests and cooperate with law enforcement, if we believe such action is required or permitted by law;
Enforce our Terms of Service, including investigating any potential violations;
Protect the safety, integrity, rights or security of our members, our Services or equipment, or any third party; or
Detect, prevent or otherwise address fraud, security or technical issues related to our Services or our partners.
Disclosure of Your Personal Data
We do not share your credit reports or scores with unaffiliated third parties (except agents acting on our behalf, as explained below).
We do not sell your Personal Information to or share your Personal Information with unaffiliated third parties for their own advertising or marketing purposes.
We may share information about you, including Personal Information, with third parties in a variety of ways, such as:
When we collaborate with third parties to provide and improve our Services. We may sometimes share information about you with third parties we collaborate with in connection with providing or improving our Services. We may also share information like the feedback you submit to us if it relates to both our Services and a partner's products. When we share information with third party collaborators, they are also obligated to not share your credit reports or scores with unaffiliated third parties or sell your Personal Information to unaffiliated third parties for their own advertising or marketing purposes. Our third party collaborators may use the information in connection with their own activities to the extent allowed under their own privacy practices (e.g., respond to your feedback, conduct additional research, or improve a feature of theirs).
Our partners when you ask for their services. We may also give you opportunities to interact with third party partners through our Services, such as when we provide you with the opportunity to review and send your personal information to a partner in order to pre-populate your application on the partner's site or we send you to the partner's site for you to provide the information directly to them. In some cases, if you click through to go to a partner's site, you will automatically be sending your personal information to that partner. When this happens, you will still have to submit your application on the partner's site. Any information you provide to the partner, whether through us or on your own, will be subject to their privacy practices and terms and conditions.
When you publicly post the information. As part of our Services, we may provide opportunities for you to publicly post reviews, questions, comments, suggestions or other content, which may include Personal Information and portions of your account designated as public profile information, like your name or user name. Anything you share in a public forum is public.
As Part of a Corporate Change. We may disclose and transfer information about you to a third party as part of, or in preparation for, a change of control, restructuring, corporate change, or sale or transfer of assets. If such a business transfer results in a material change in the treatment of your Personal Information, you will be notified by e-mail (using the primary email address on your account) or by a prominent notice on our site.
For Legal Reasons. We reserve the right to transfer or disclose information about you to third parties for certain legal purposes.
With Your Consent. There may also be other limited contexts in which we share specific types of personal information with your express consent.
